Terms & Conditions

1. Services Provided

​

Next Gen Labour Solutions Pty Ltd offers site preparation services as an independent subcontracting business.
Services may include site cleanup, minor demolition, manual excavation and material handling.

We may subcontract additional workers as required to complete the work. All subcontractors engaged remain independent contractors of our Company, and we remain your primary point of contact.

 

2. Independent Contractor Status

​

Next Gen Labour Solutions Pty Ltd operates as a proprietary limited company under its own ABN and ACN.

We are not employees of the client, and neither are any subcontractors engaged by us.
Accordingly:

  • You are not responsible for superannuation, PAYG withholding, leave entitlements, workers’ compensation, or any other employee-related obligations.

  • All subcontractors engaged by us operate under their own ABN and are contracted by the Company, not by you directly.

 

3. Invoicing and Payment

​

  • All labour performed will be invoiced by Next Gen Labour Solutions Pty Ltd under our registered ABN.

  • Standard payment terms are seven (7) days from the invoice date unless otherwise agreed in writing.

  • Late or unpaid invoices may result in:

    • suspension of services;

    • late fees;

    • recovery costs.

  • Hours are invoiced based on time sheets or hours provided/approved by the client or their site representative.

 

4. Work Conditions

​

  • The Client must provide a safe, lawful, and compliant work environment in accordance with applicable workplace health and safety legislation.

  • We reserve the right to refuse or cease work if site conditions are unsafe, unlawful, or create unreasonable risk to workers or subcontractors.

  • The Client is responsible for ensuring safe access, adequate supervision (where necessary), and compliance with safety requirements relating to the tasks performed.

 

5. Liability

 

While we take all reasonable care to perform work safely and professionally:

  • Next Gen Labour Solutions Pty Ltd accepts no liability for delays, loss, damage, or additional costs arising from circumstances beyond our control (including site conditions, weather, changes to scope, or actions of third parties).

  • The Client remains responsible for site safety, site conditions, and any plant/equipment provided to our subcontractors.

Nothing in these Terms excludes liability where it cannot be lawfully excluded.

6. Governing Law

​

These Terms and Conditions are governed by the laws of the State or Territory in which the work is performed, unless otherwise agreed in writing.
